Privacy Policy

LACOSTE CANADA, Inc., duly authorized for distributing products under the trade-mark LACOSTE (hereinafter referred to as “Lacoste,” “we” or “us”), by the French company LACOSTE S.A. of which it is a subsidiary, itself duly authorized by Lacoste S.A., Sporloisirs and Lacoste Alligator (hereinafter referred jointly, included Lacoste S.A. and its subsidiaries, to as the “Lacoste Group”), values its customers and respects their privacy.

This privacy policy (this “Policy”) describes the personal information we may collect from you on the web site located at http://shop.lacoste.ca (the “Site”), the purposes for which we collect it, how we use it and when we may share it with third parties. This Policy also describes the choices you can make about how we collect, use and disclose your information. Lacoste will not collect, use or disclose your personal information other than in compliance with this Policy.
Please read this Policy carefully before using the Site or the services available on the Site. By using or visiting the Site, or making a purchase from the Site, you confirm your acceptance of the terms of this Policy. Certain areas, features, or functionality of the Site, may be subject to different or additional terms, rules, guidelines or policies (“Additional Rules”), and we may provide such Additional Rules to you via postings, pop-up notices, links, or other means at the time that you access or use the relevant area, feature or functionality. From time to time, such Additional Rules may conflict with this Policy; in the event of such a conflict, the Additional Rules will control.
Lacoste respects your privacy and is committed to maintaining and using your information responsibly. Except as otherwise mentioned below, this Policy only addresses the use and disclosure of information we collect from you on the Site. By visiting the Site, posting or viewing any content on the Site and/or by making a purchase on the Site, you represent and warrant that you have read, understand, have the legal capacity to, and hereby agree to be legally bound by this Policy and each of its terms. If you do not agree with the terms of this Policy, please do not use the Site.

A. Changes to this Policy

As you are likely aware, the Internet offers a medium that requires constant updates and revisions in order to ensure the Site is capable of meeting your needs. Lacoste will work hard to ensure the Site meets your needs. Given this, we may change the terms of this Policy from time to time. By continuing to use any of the Site after we post any such changes, you accept this Policy, as modified. We may change, restrict access to, suspend or discontinue the Site, or any portion of the Site, at any time.

B. Your Personal Identifiable Information

(i) Secure Socket Layer (SSL) technology Any personal information you provide to us, either on the Site (e.g. name, address, e-mail address, credit card number and its expiration, telephone number) or otherwise (e.g. by mail) is maintained in private files on our secure Web server and our internal systems. Orders placed on the Site are encrypted using Secure Socket Layer (SSL) technology, an industry standard that is used by vendors to ensure the security of online business. It employs the essential functions of mutual authentication, data encryption, and data integrity for secure transactions. Whether or not you provide your personally identifiable information to us is completely up to you, but if you choose not to provide the information we request, you may be unable to use some of our services. We take special steps to safeguard your personal information and since your password is protected, only you can access your account information. We recommend that you keep your password private and always sign-off of your account and close your browser when you are finished shopping. (ii) Using your personally identifiable information We collect your personally identifiable information to serve you better and to provide you with a customized experience while using the Site for browsing and shopping. We may use your personally identifiable information to fulfill one of your requests such as sending you promotional emails, fulfilling and delivering your orders, informing you about our new products, services and offers, responding to your comments or questions, contacting you if necessary while processing an order, and generating web analytics to compile user data for marketing purposes. For instance, if you give us your email address when you register or enter a contest, we will send you emails about promotions. We will give you the opportunity to opt-out of receiving emails from us by following the opt-out instructions described at paragraph E of this Policy. However, if you choose to have certain of your personally identifiable information removed, you may be unable to use some of our services.

(iii) Sharing your personally identifiable information with third parties We may share your personally identifiable information with third parties that perform services for us, such as our affiliates, all affiliates of Lacoste S.A., Lacoste Canada Inc. and Lacoste US Inc., and more generally all members of the Lacoste group, advertisers, partners, potential business partners, and other unaffiliated entities. These companies and individuals are hired to perform functions on our behalf or at our request, such as fulfilling and processing orders, processing credit card payments, performing data and marketing analysis, fulfillment to process orders, and providing customer support. While such third parties may be provided with access to personally identifiable information needed to perform their function, they may not use or disclose such data for any other purpose. Additionally, our service providers are contractually required to maintain all the information collected for us in strict confidence.
Your personally identifiable information may also be combined with other personally identifiable information (such as demographic information and past purchase history) available from our records and other sources. Such information may be used to make our future marketing efforts more efficient. This information may be shared with our third party service providers that assist us with our marketing efforts and with other marketers whose products or services we feel may be of interest to you.
If you do not wish us to share your personally identifiable information with our third party service providers or other marketers, please email us at customerservice-ca@lacoste.com. However, if you decide not to have certain of your personally identifiable information shared with such parties, you may be unable to use some of our services.
Except as mentioned above, Lacoste will not sell, rent or share your personal identifiable information to third parties. However, in the event of a sale of all or substantially all of our business or another similar transaction, we may transfer or disclose your personal information to a purchaser or prospective purchaser, who may collect, use and disclose such information for the purposes of evaluating the proposed transaction or operating and managing the affairs of the acquired business, or for other purposes identified in this Policy.

(iv) Transferring your personally identifiable information to a foreign country Your personally identifiable information may be processed in a foreign country (e.g. in the United States and France) by members of the Lacoste group and their authorized third party service providers and may be accessible to law enforcement and national security authorities of that jurisdiction. If you do not wish us to transfer your personally identifiable information to a foreign country, please email us at customerservice-ca@lacoste.com. However, if you decide not to have certain of your information transferred to a foreign country, you may be unable to use some of our services.

(v) Linking to web sites operated by third parties The Site may contain links to web sites operated by third parties. These web sites may collect your personally identifiable information. This Policy does not apply to the practices of third parties and we do not assume any responsibility for, and by using the Site and/or accessing a third party’s web site from the Site, you release Lacoste, the Lacoste Group and their affiliates from any responsibility for the actions, practices and omissions of third parties. Check the privacy policy of each site you visit.

(vi) Disclosing your personally identifiable information You should also be aware that Lacoste cannot assure you that all of your personally identifiable information will never be disclosed in a manner that is not described in the present Policy. For example, and without limiting the generality of the foregoing, it is possible that Lacoste may be forced to disclose, in some cases, personally identifiable information by law, governmental request or court order or based on our good faith belief that it is necessary to conform or comply with such law, request or court order or to protect the users of the Site or the public. Some third parties may also unlawfully intercept transmissions or private communications, or access thereto; or users can make abusive or malicious misuse of the personally identifiable information they collect on the Site. Therefore, although Lacoste uses practices conform to industry standards to protect your privacy, Lacoste cannot guarantee you that your personally identifiable information or your private communications will always remain private, and you should not expect them to remain private. We will keep your personally identifiable information only as long as it is reasonably necessary for the purposes described in this Policy or such longer period as may be required by applicable law.

C. Your Non Personal Identifiable Information

When you visit the Site, we may collect certain anonymous information about your visit. For example, when you browse the Site, we may monitor statistics such as the number of people that visit the Site, peak hours of visits, which page(s) are visited on the Site, from which domain our visitors come (e.g., aol.com, hotmail.com, etc.), and which browsers people use to visit the Site (e.g., Netscape Navigator, Microsoft Internet Explorer, etc.), broad geographical information, site-navigation pattern, etc.
We may obtain this non-personal information by placing a “cookie” on your computer’s hard drive so we can recognize you as a new or return user and personalize your experience. A cookie is a piece of data stored on your computer’s hard drive that enables us to track and target your shopping experience and order as you shop on our site. For example, cookies are used to save your Cart information so you can browse from page to page without losing that information. Cookies do not contain personally identifiable information. Cookies can be stored on your hard drive or on a temporary file in which case they are erased when you turn off your computer browser. You can disengage Lacoste’s cookies using the properties of your Internet browser. Please refer to the help function on your browser for information on how to disengage cookies. Please note that when you disengage cookies, it is possible that certain functions of the Site could not be exploited properly.
Lacoste shares statistical, demographic and other non-personally identifiable information with third party companies to help manage and optimize our communications. We use the services of a marketing company to help us measure the effectiveness of our advertising and marketing.

D. Account Information

You have the option of creating an account with Lacoste when you make a purchase on the Site. You agree that the information you supply during that process will be accurate and complete. You also agree not to (i) select, register, or attempt to register, or use the name or any other identifiable information of another person with the intention of impersonating that person; (ii) use the name of anyone else without authorization; (iii) use a name in violation of the intellectual property rights of any person; or (iv) use a name that Lacoste considers to be offensive. Lacoste reserves the right to reject or terminate the account of any person that violates the terms of this Policy. You will be responsible for preserving the confidentiality of your password and will notify Lacoste of any known or suspected unauthorized use of your account. Further, you agree that you are responsible for all statements made and acts or omissions that occur on your account while your password is being used.
You should not authorize any third party to access or to use the Site in order to act on your behalf. If you do so, you will be responsible for all acts and/or omissions of that third party on or in connection with the Site. You are responsible for maintaining the confidentiality of your password, and you are fully and always responsible for all activities that occur under your password. You agree to immediately notify us via customerservice-ca@lacoste.com, of any unauthorized use of your password or account information, or any other breach of security. We cannot and will not be liable for any loss or damage arising from any unauthorized use of your account.
Lacoste reserves the right to access and disclose any information including, without limitation, account information to comply with applicable laws and lawful government requests. You must be at least 13 years old to use the Site.

E. Opting Out

We want to communicate with you only if you want to hear from us. If you prefer not to receive promotional information from us, or if you do not want us to use your information to enhance your shopping experience, please let us know by contacting us via email at customerservice-ca@lacoste.com, by calling us at 1-800-452-2678 or by writing us at Lacoste Canada - 4200, boulevard Saint-Laurent, bureau no 901 - Montréal, Québec, H2W 2R2 – Customer Service. Please be sure to include your full name and the e-mail address you used when you registered with or made a purchase from us. It may take up to 10 days to process your postal mail request, during which period you may continue to receive communications from Lacoste. You may also unsubscribe by using the unsubscribe link situated at the bottom of any promotional message you receive from Lacoste.
If you choose to opt out, you will not receive any direct mail, telephone or email solicitations for products or services from Lacoste, though Lacoste may still use your personal information (and may share your information with our service providers) to provide you with services relating to your online shopping needs.

F. ACCESS, MODIFICATIONS, INQUIRIES, AND COMPLAINTS

Lacoste will ensure that the personal information it collects is as accurate, complete, and up-to-date as is necessary for the purposes for which it is to be used. You are entitled to request access to and correction of your personal information collected by us. If you have consented to the collection, use and/or disclosure of personal information as identified herein, please note that you can also withdraw your consent at any time by communicating with us as provided above.

G. Survival

If any part of this Policy is determined to be invalid or unenforceable pursuant to applicable law, then the invalid or unenforceable provision will be deemed to have been superseded by a valid enforceable provision that most closely matches the intent of the original provision, and the remainder of the Policy shall continue in effect. A printed version of this Policy and of any notice given in electronic form shall be admissible in judicial or administrative proceedings based upon or relating to this Policy to the same extent and subject to the same conditions as other business documents and records originally generated and maintained in printed form. All rights not expressly granted herein are reserved.

H. Assignment of the Policy

We may assign this Policy, in whole or in part, at any time with or without notice to you. You may not assign this Policy, or any part of this Policy, to any other party. Any attempt by you to do so is void.

I. Waiver

Our failure to exercise or enforce any right or provision of this Policy shall not constitute a waiver of such right or provision.

J. Headings

The section titles in the Policy are for convenience only and have no legal or contractual effect.

K. Governing Law and Jurisdiction

This Policy shall be governed by and construed in accordance with the laws of the province of Quebec and the federal laws of Canada applicable therein, without giving effect to any principles of conflicts of law. You and Lacoste hereby agree to exclude the application of the United Nations Convention on Contracts for the International Sale of Goods. You and Lacoste further agree to submit to the exclusive jurisdiction of the courts of the province of Quebec, district of Montreal. If any provision of this Policy shall be unlawful, void or for any reason unenforceable, then that provision shall be deemed severable from this Policy and shall not affect the validity and enforceability of any remaining provisions. This is the entire agreement between the parties relating to the subject matter herein and shall not be modified except by writing, signed by both parties.
