    Lacoste Nitto ATP Finals Tickets Prize Draw

  1. The Terms and Conditions apply to the Lacoste Nitto ATP Finals Tickets Prize Draw. By accessing, entering into and/or using the Prize Draw, the Entrants understand and agree to be bound by the Terms, and to comply with all applicable laws and regulations. All entry instructions form part of the Terms.
  2. 1. GENERAL :
  3. 1.1. The Promoter of this Prize Draw is Lacoste UK Limited, a limited company duly organized and existing under the laws of UK.
  4. 1.2. Words denoting the singular number shall include the plural number and vice versa, words denoting the masculine gender shall include the feminine gender, words denoting persons shall include corporations, partnerships and other corporate entities.
  5. 1.3. Entrants hereby certify that they are over eighteen (18) years of age and legally competent and duly authorized to use the Prize Draw.
  6. 1.4. Entrants undertake not to use the Prize Draw for any purpose that is unlawful or prohibited by these Terms nor in any manner that could damage, disable, overburden, or impair any server, or the network(s) connected to any Promoter’s server, or interfere with any other party's use and enjoyment of the Prize Draw.
  7. 1.5. The Promoter reserves the right to amend the Terms and/or cancel the Prize Draw in whole or in part at its sole discretion.
  8. 1.6. Any information and content made available through the Prize Draw is subject to various updates and changes, especially regarding events dates and times. The Winner shall be solely responsible for obtaining the correct dates, starting times of events, and delivery or pick up details. The Prize Draw may contain information which is not owned and/or controlled by the Promoter, including without limitation sporting events schedules and tables. For example, when publishing the dates of sporting events the Promoter is entirely dependent upon information provided by third parties. Therefore it is recommended that Entrants verify all third party information published. The Promoter uses great efforts to publish accurate information but will not be held liable for any third party information and Entrants may not rely upon such third party data without independently verifying it. If an event is cancelled, interrupted, rescheduled or postponed, the Winner shall refer to the organiser’s General Terms and Conditions of Sale.
  9. 1.7. The Prize Draw may present links to affiliated sites, such as hotel booking sites, etc. Entrants’ correspondence or business dealings with such affiliated sites, including payment and delivery of related goods or services, and any other terms, conditions, warranties or representations associated with such dealings, are solely between Entrants and the affiliated sites. The Promoter is not responsible or liable for any loss or damage of any sort incurred as the result of any such dealings.
  10. 2. FUNCTIONING OF THE PRIZE DRAW :
  11. 2.1. The Prize Draw opens on October 3rd, 2018 and closes at midnight on October 28th, 2018. No entries shall be accepted before the Opening Date or after the Closing Date. Entries are limited to one (1) entry per household. Entries not in accordance with the Terms and entry instructions are invalid. The Prize Draw is open through Facebook.
  12. 2.2. The Prize Draw is open to persons aged eighteen (18) or over, who are residents of the United Kingdom, Isle of Man and Channel Islands. The Promoter accepts no responsibility for entries that are misdirected, lost, stolen, delayed, damaged or corrupted due to any computer malfunction, virus, bug, delay or other reason whatsoever. The Prize Draw is specifically closed to employees of the Promoter, any associated companies, their families and anyone professionally involved in the Prize Draw.
  13. 2.3. NO PURCHASE OF ANY KIND IS NECESSARY TO TAKE PART IN THIS PRIZE DRAW. Entrants do not have to buy any product in order to enter this Prize Draw.
  14. 2.4. The Prize Draw will be made on October 29th, 2018 by an independent person and the Promoter’s decision is final. The Winner for the Prizes will be drawn at random from all entries received. No correspondence will be entered into.
  15. 2.5. The Winner will receive two (2) tickets to the final of the Nitto ATP Finals on Sunday 18th November 2018 in the UK.
  16. 2.6. Associated travel and accommodation costs of the Winner, including travel to and from the tournament venue from the Winner address in the UK and one (1) night hotel accommodation in London (the Winner can choose either Saturday 17th of November or Sunday 18th November for the hotel stay) will be covered by the Promoter, at the Promoter’s sole discretion. The Winner shall be responsible for any additional expenses.
  17. 2.7. The Winner will be contacted by email by October 30th, 2018 on the e-mail address provided at the point of entry. The Winner agrees that the Promoter can use the contact details the Winner has entered at the time of participating to the Prize Draw to inform the Winner. When the Promoter notifies a Winner by email, the Winner must provide confirmation of receipt by a reply email at the latest. If the Winner cannot be contacted by either telephone or email by 12pm on November 1st, 2018 the Promoter reserves the right to select another winner at random from the remaining eligible entries and thereafter until a confirmed winner is found.
  18. 3. SPECIAL PROVISIONS AND LIABILITY :
  19. 3.1. Except for the Promoter's obligations towards the Winner as set forth herein, the Promoter shall not have any liability or bear any responsibility to any guest or third party using the Prize.
  20. 3.2. The Prizes may be altered or varied at the Promoter’s sole discretion and substituted with a prize which, in the Promoter’s sole opinion, is a suitable alternative. No cash alternatives are available. The Prizes are non-transferable and may not be sold, offered for sale, coupled or bundled with any other product or services or used for any commercial or promotional purposes whatsoever.
  21. 3.3. All information submitted to the Promoter as part of this Prize Draw will be treated in accordance with the Promoter’s Privacy Policy. The personal data that Entrants provide will be held and processed in accordance with the requirements of the Regulation (EU) 2016/679 General Data Protection Regulation.
  22. 3.4. The Promoter shall not be held liable if the Winner is denied admission to an event nor for any damages that the Winner may incur if denied entry or expelled from the event by the local authorities or the organiser, except insofar as the denial is due to willful misconduct of the Promoter. The Winner shall visit an event on its own risk. The Promoter shall not be held liable for damages that the Winner may suffer while travelling from or to the event or attending such an event. Events are held under the sole responsibility of the event’s organiser. The Promoter cannot under any circumstances be held responsible. The Winner shall be solely responsible for abiding by the rules, regulations, policies and the code of conduct established by the local authorities and/or organiser.
  23. 3.5. To the maximum extent permitted by law under no circumstances shall the Promoter Parties or any of its subsidiaries, affiliates, stockholders, directors, officers, employees, licensors or suppliers be liable jointly or severally to any Entrant for any claims or actions of any kind whatsoever, for any indirect, consequential, incidental, special, punitive or exemplary damages or losses to persons or property, including, but not limited to, damages for loss of revenue, profits, use, data or other intangibles, which may be sustained in connection with receipt, ownership and/or use of the Prizes or access to the Prize Draw or any content appearing via the Prize Draw, whether or not characterised in negligence, tort, contract or other theory of liability, and regardless of any failure of an essential purpose of a limited remedy. If any applicable authority holds any portion of this section to be unenforceable, then the liability of the Company Parties shall be limited to the fullest possible extent permitted by applicable law.
  24. 3.6. Entrants agree to indemnify, defend and hold harmless the Promoter, its officers, directors, employees, agents, licensors, suppliers and any third party from and against all claims, losses, expenses, damages and costs, including reasonable attorneys' fees, resulting from any violation of these Terms by Entrants.
  25. 3.7. English law governs this Prize Draw and each party submits to the exclusive jurisdiction of the English courts.
