The two companies
Lacoste Switzerland A.G. (hereafter "Lacoste Switzerland"), company with its registered office at 109 Bederstrasse, 8002 Zurich, Switzerland
Lacoste E-Commerce S.A.S. (hereafter "Lacoste E-commerce") société par actions simplifiée French simplified joint-stock company with a share capital of €3,684,000, with its registered office located at 23-25, rue de Provence, 75009 Paris (France), registered in the Paris Trade and Companies Register under the number 403 285 513,
developed a loyalty programme entitled "LE CLUB LACOSTE" (hereafter referred to as the "Loyalty programme" or "LE CLUB LACOSTE"), designed to reward their customers who frequently make purchases at the Lacoste Switzerland boutiques and/or on the www.lacoste.com e-commerce site, operated by Lacoste E-commerce.
The two companies, Lacoste Switzerland and Lacoste E-commerce, are jointly responsible for the Loyalty programme and the General Conditions hereafter apply to all participants of the Loyalty programme.
Any reference to “us” or “our” within the context of these General Conditions refers to both Lacoste Switzerland and Lacoste e-commerce.
Any reference to “you”, “your” or “the Member” refers to you, as a member of LE CLUB LACOSTE
These general conditions of LE CLUB LACOSTE (hereafter the “General Conditions”) govern this loyalty programme, and apply from the time you join LE CLUB LACOSTE.
The LE CLUB LACOSTE loyalty programme is in force in all the Lacoste Boutiques located in Switzerland, with the exception of those indicated in the appendix, as well as on the www.lacoste.com e-commerce site (hereafter the "Site"), for purchases made from Switzerland (hereafter the "Scope").
A Lacoste Boutique consists of a point of sale operating under the Lacoste trade name and exclusively intended for the sale of premium Lacoste-Brand products, to the exclusion of any others (hereafter the "Lacoste Boutiques").
Lacoste outlet stores, any Multi-brand, Franchise and Concession stores that sell Lacoste-Brand products, as well as any Lacoste Boutiques and websites outside Switzerland, are expressly excluded from the Scope.
Members join LE CLUB LACOSTE (hereafter "the Membership") at one of our Lacoste Boutiques or directly on the www.lacoste.com/ch/en/leclublacoste Site.
To join directly at a Lacoste Boutique, simply ask the sales advisor to join LE CLUB LACOSTE, with it being specified that any membership of LE CLUB LACOSTE is strictly free of charge and is not subject to any purchase obligation.
You may also join LE CLUB LACOSTE directly on the Site, by clicking on My account and creating a personal account, via a compatible computer, tablet, or telephone.
When you join, some mandatory or optional information will be requested, as indicated hereafter, with it being specified that the mandatory information must be provided:
- First name,
- Email address,
- Post Code,
- Date of birth,
- Mobile telephone number.
You will only be able to fully benefit from the Loyalty programme and the benefits it offers if you provide all the mandatory information.
You must also indicate whether you wish to receive communication relating to the Lacoste Brands, either by confirming this to the sales advisor, or directly and expressly agreeing to this in your Customer Area (such as this term is defined hereafter, after registration on the Site.
Your Membership is effective after it is registered by the sales advisor at the Lacoste Boutique and after receipt of the welcome email confirming your Membership, or when you confirm on the Site. A welcome email confirming your Membership and the activation of your Loyalty account (as defined hereafter) will be sent to you within twenty-four (24) hours of your registration, subject to the express condition that you have provided your email address.
Any customers who was already registered in our customer data base at the time of the launch shall automatically become members of LE CLUB LACOSTE.
We would like to draw your attention to the fact that as this loyalty programme is common to the Lacoste Boutiques and the Site, you will only be assigned a single, unique loyalty account, with your email address as the username (hereafter referred to as the "Loyalty account"), regardless of the location of your purchases in Switzerland.
You will be responsible for keeping your information up-to-date, by directly modifying this at your reference Lacoste Boutique (as defined hereafter in §5), directly on your Customer Area, or by submitting a request using the contact form available at the address www.lacoste.com/ch/en/contactus . You guarantee the accuracy of all the information provided and you shall be solely responsible for any incorrect, incomplete or outdated information.
Indeed, under no circumstances shall we be held liable in the event you fail to receive an offer due to outdated, incorrect or missing information.
LE CLUB LACOSTE is only offered to natural person customers. For minor natural persons aged under 18, the signature of the minor's legal representative shall be required at the time of joining.
Membership is strictly personal; only you may benefit from the benefits described below.
The use thereof by any third party is forbidden and cannot be accepted by any sales advisor in the event it is presented at the till.
You can hold one Loyalty account. To this end, and in the event an email address or a mobile telephone number are connected to several Loyalty accounts, we are entitled to merge the aforementioned Loyalty accounts into a single Loyalty account.
Under these conditions, any points that may have been accumulated and are still valid shall be added to the points accumulated on the Loyalty account retained.
To enable us to optimise the management of your Loyalty account and to provide you with the best benefits, at the time of joining the programme, you will be considered connected to the authorised point of sale at which you joined (hereafter the "reference Lacoste Boutique"), with the Site then expressly considered as a separate reference Lacoste Boutique.
You may modify your reference Lacoste Boutique at any time, directly on your Customer Area or by writing to the customer service department using the contact form available at the following address www.lacoste.com/ch/en/contactus
To access your personalised area (hereafter "the Customer Area") on the Site after joining at a Lacoste Boutique, you must activate this by entering the same email address you provided when joining, and creating a password, at the following internet address: www.lacoste.com/ch/en/account.
If you joined via the Site, you will have access to your personalised area (hereafter "the Customer Area") within twenty-four (24) hours of joining; this area shall be accessible via the following internet address: www.lacoste.com/ch/en/account.
Once you have accessed the aforementioned website, and in order to access your Customer Area, you must provide the email address and password you provided when you joined.
Among other things, the Customer Area will allow you to do the following:
- access your Loyalty account,
- consult your loyalty status and your progress,
- consult your online purchase history,
- modify your personal information, as well as your reference Lacoste Boutique,
- be informed of the latest news regarding LE CLUB LACOSTE,
- visualise and access your benefits.
The Customer Area is provided to you as is. In particular, we do not guarantee that the Customer Area shall be available and fully operational 24 hours a day, without interruptions. Access to the Customer Area may therefore be interrupted without notice in the event of technical problems or for maintenance reasons.
It is your responsibility to protect your computer, tablet, or telephone. We shall not be held liable for the damage that may be caused to your computer, tablet, or telephone, or any loss of data that may stem from your use of the Customer Area.
If you wish to become a member of The Lacoste Players, Lacoste, data controller, implements the processing of personal information concerning you in order to manage its loyalty programme.
The information collected are essential for this operation and is intended for the Lacoste departments concerned, as well as, where appropriate, its subcontractors, data processor or service providers.
Pursuant to the legislation in force, you have a right to access, correct, remove, or limit the processing of your information; these rights may be exercised via the contact form at www.lacoste.com/ch/en/contactus .
By communicating information at the time of joining or through your Customer Area, you guarantee that you are using your true identity and that all the information provided is true, accurate, up-to-date and complete at the time you provide us with this information.
If you notice that one or more pieces of information provided are incorrect or are no longer valid, you must modify this either directly at the Lacoste Boutique, or in your Customer Area, or through the contact form at the address www.lacoste.com/ch/contactus.
Should you fail to do so, we shall not be held liable for the consequences that may result from this.
We have implemented and guarantee the maintenance of all appropriate protection to guarantee that our internal procedures regarding the security of your personal information are in compliance with the regulation in force. In addition, we shall make every effort to ensure that the third parties that work with us, under contract, as service providers, to make LE CLUB LACOSTE and its content available for you, provide adequate protection for the personal information to which they have access. We limit the access to the personal information concerning you to employees bound by appropriate confidentiality obligations, and whose contact with this personal information we believe is justified in the context of their role and/or to provide you with products and services.
We shall carry out all the procedures necessary to guarantee the secure processing of your personal information. In particular, we shall take all the precautionary measures necessary to protect your personal information against loss or abuse, and we shall use security procedures to prevent any unauthorised access to this personal information. All the personal information we collect is stored on a server that offers all the security guarantees; the information is stored for a period that does not exceed the period necessary for the fulfilment of the objectives indicated in the General Conditions.
We may be required to transfer your personal information to some of our service providers and subcontractors who help us, in particular, with managing your change of loyalty status, giving you access to certain benefits, processing commercial offers, sending you satisfaction surveys (where applicable), analysing your use of your Loyalty account, and assisting with the maintenance of the Site management in order to improve the quality and effectiveness thereof, as well as your use of the Site, with the understanding that the aforementioned service providers are bound by a contractual duty of confidentiality, as well as adherence to the laws in force regarding the protection of your personal information.
On the other hand, and provided you have expressly accepted this at the time of joining, we may send you information and special offers relating to the Lacoste Brand and extending beyond LE CLUB LACOSTE.
We store your personal information in Switzerland and in the European Economic Area (“EEA”, namely the 27 member-states of the European Union, as well as Norway, Iceland, and Liechtenstein). If we need to transfer and store your personal information in a location outside Switzerland or the EEA, this transfer will be carried out in accordance with the laws in force regarding personal data protection.
We reserve the right to modify our data protection policy, in accordance with the laws in force regarding personal data protection. In this case, the modifications of our data protection policy shall be indicated herein.
We hereby inform you that when you visit the Site as well as the Customer Area, we may save some small digital files known as "cookies" on your computer, telephone, or tablet, which will be saved by your browser on your hard drive, your tablet, or your telephone.
We may use the following three types of cookies:
• Technical cookies relating to the functionalities of the website
These cookies enable you to visit the entire website, use the functionalities thereof and save your preferences.
• Website analysis cookies
These cookies enable us to measure website visits and your reactions to the content we offer. They enable us to improve the website.

LE CLUB LACOSTE sets out four (4) loyalty statuses, namely:
- “LEVEL 1” status (hereafter “LEVEL 1 status”),
- “LEVEL 2” status (hereafter "LEVEL 2 status”),
- “LEVEL 3” status (hereafter “LEVEL 3 status”),
- and “LEVEL 4” status (hereafter "LEVEL 4 status”),
LEVEL 1 status is obtained at the time of joining, while LEVEL 2 status, LEVEL 3 status, and LEVEL 4 status are only accessible if certain conditions are met.
- Earning of Loyalty points
Regardless of your status, you must indicate:
- your email address and your name (as well as any other additional identification information, where applicable) at the till of the Lacoste Boutique during each visit, and prior to paying for your purchases at the Lacoste Boutique,
- Or your email address on the Site when confirming your order; regardless of the sum of your purchases, with "purchases" referring to all purchases, with the exception of purchases made using a credit note.
You earn one loyalty point (hereafter referred to as the "Loyalty point") per pound spent at a Lacoste Boutique or on the Site, without distinction, with it hereby specified that the threshold for the awarding of loyalty statuses is freely set by Lacoste Switzerland and/or Lacoste E-Commerce, who reserve the right to modify this at any time, at their sole discretion. In the event of modification, you will be informed of the new thresholds in force by any method we deem appropriate, including, but not limited to, by displays at Lacoste Boutiques or by the update of the General Conditions on the Site and in the Customer Area.
We hereby inform you that any initial purchases made (whether in a Lacoste Boutique or on the Site) on the date of joining shall be immediately eligible for points.
You may only earn Loyalty points if the sales advisor is able to locate your Loyalty account, after you provide your name and email address at the Lacoste Boutique, or by providing your email address on the Site.
You shall only earn Loyalty points and receive benefits in Switzerland or on the www.lacoste.com/ch Site.
The Loyalty points earned in store will be added to your Loyalty account within twenty-four (24) hours of the purchase; the loyalty points earned on the Site will be added to your Loyalty account thirty (30) days after shipment of your order. All points are valid from one (1) year from the time they are added to the Loyalty account.
However, it will be possible to earn points for a purchase that has not been added to your Loyalty account:
- either by visiting a Lacoste Boutique within sixty (60) days of the purchase, with the corresponding receipt. Subject to the reservations indicated, we will then credit your Loyalty account with the corresponding loyalty points;
- or through the form to be completed directly on the site www.lacoste.com/ch/en/contactus, with it being specified that a scanned copy of the receipt, as well as your full name and address must be
provided in the email. A confirmation email will be sent to you once your request has been acknowledged.
On the other hand, in the event we issue a refund for your purchase, the number of Loyalty points corresponding to the refund will be deducted from your Loyalty point balance.
You are free to consult your Loyalty points balance free of charge, directly in the Customer Area, by asking at a Lacoste Boutique, or by consulting your latest till receipt or bill issued by Lacoste E- Commerce in the case of an online purchase, which will indicate your points balance. You may also make a balance enquiry free of charge using the contact form on the site www.lacoste.com/ch/en/contactus.
- How to progress from LEVEL 1 to the other statuses?
As indicated above, Membership of LE CLUB LACOSTE grants you LEVEL 1 status.
To progress to another status, you must earn a certain number of Loyalty points over a period of twelve
(12) consecutive months, the period of validity of the Loyalty points, without any other conditions; the progression to each status is free of charge.
Therefore, to progress:
- to LEVEL 2, you must earn at least three hundred (300) Loyalty points over a period of twelve (12) consecutive months;
- to LEVEL 3, you must earn at least nine hundred (900) Loyalty points over a period of twelve (12) consecutive months;
- to LEVEL 4, you must earn at least one thousand five hundred (1500) Loyalty points over a period of twelve (12) consecutive months;
- Change of status
In the event of progression to a new status, the sales advisor at the Lacoste Boutique will immediately inform you, and shall offer you the corresponding Lacoste gift (cf. article 12 hereafter). You will also receive a confirmation email regarding your change of status.
In the event you do not immediately receive your Lacoste gift or in the event of progression following a purchase on the Site, you will receive a confirmation email regarding your change of status within twenty-four (24) hours of the progression to the new status, which will invite you to collect your gift in store or through your Customer Area. The Customer Area will also be immediately updated.
The progression to a new status is valid for a fixed period of twelve (12) months from the date of the progression in question. For this period, you will receive benefits specific to this status, as described hereafter.
To retain the status acquired, you must earn the minimum number of Loyalty points indicated above, each year.
In the event you do not earn the required number of points, at the end of the twelve (12) months, you will automatically return to Level 1 or the status that corresponds to the number of points earned during these twelve (12) months, without the right to appeal this, and without any further information.
However, we hereby inform you that an information email will be sent one (1) month before the end of the validity of your current status.
Progress to the different status will be possible again at any time, in the event you earn a sufficient number of Loyalty points over a twelve (12)-month period, under the same conditions as set out above.
We would like to draw your attention to the fact that at the time of each change of status that entails the issue of the associated Lacoste gift (in accordance with the stipulations of article 12 hereafter), the number of Loyalty points necessary to reach this status shall not be deducted from your points balance; the Loyalty points will continue to accumulate.
In addition, and in the event that you earn enough Loyalty points to access two loyalty statuses at the same time, we hereby inform you that you will only be entitled to receive the Lacoste gift that corresponds to the highest status, and not both Lacoste gifts, which you expressly agree to.
LE CLUB LACOSTE enables you to benefit from preferential offers, as described hereafter, based on your status.
- LEVEL 1
LEVEL 1 gives you access to the following benefits:
o Special commercial operations (commercial offers, invitations to private sales…): you will benefit from different special commercial offers implemented at Lacoste Boutiques and on the Site. You will be informed of these commercial operations by any method we deem suitable and appropriate (including, but not limited to: displays at Lacoste Boutiques or on the Site, letter, email, SMS, etc.).
o Digital personal shopper: you will be able to access the services of a virtual stylist assistant who, based on a questionnaire to categorise your style, will propose Lacoste products and provide suggestions of how to combine them.
o Style tips: you will be able to access exclusive content of the Lacoste brand, its products and its history in the form of videos, articles and newsletters.
o Birthday offer: fourteen (14) days before your birthday, you will receive an email containing a discount of a unit value of thirty Swiss francs (30 CHF), which may be used from the time of receipt of the email, for a fixed period of sixty (60) days, for purchases of at least one hundred and fifty Swiss francs (150 CHF) at a Lacoste Boutique and on the Site (excluding sale or discounted items); this voucher may not be used in conjunction with any other promotion or sale.
We would like to draw your attention to the fact that the issue of this Birthday offer is:
- reserved for Members that provided their date of birth;
- reserved for Members that provided their email address and chose to opt-in to allowing us to use your personal information for commercial purposes;
- reserved for Members that have not benefited from a birthday offer during the previous twelve (12) months;
- valid for sixty (60) days following the sending of the email; after this, the offer shall expire;
- conditional upon your birthday being recorded and processed by our computer systems the day before your birthday at the latest. Therefore, in the event you join the programme on your birthday or the day before, without our computer systems having the chance to process the
information, you will not benefit from the Birthday offer for the first year, which you expressly agree to.
o Exchange without receipt in Lacoste Boutiques only: we allow you to exchange any item purchased at a Lacoste Boutique and which appears in the purchase history of your Loyalty account, without having to provide the receipt. The exchanged product must be returned in its original condition and packaging. Failing this, we will be unable to accept the product in question. The conditions of exchange are, however, subject to the conditions of exchange implemented by each Lacoste Boutique.
- LEVEL 2
In addition to the benefits to which you are entitled under LEVEL 1, LEVEL 2 entitles you to the following benefits:
o One free Lacoste product: Members that have earned at least three hundred (300) Loyalty points over a period of twelve (12) months shall receive a blue Lacoste sports towel, with it hereby specified that you may only claim one Lacoste towel per twelve (12)-month period.
o Exclusive polo customisation: using the Site polo customiser, you will have the possibility to purchase a customised polo with exclusive customisation elements.
- LEVEL 3
In addition to the benefits to which you are entitled under LEVEL 2, LEVEL 3 entitles you to the following benefits:
o One free Lacoste product: Members that have earned at least nine hundred (900) Loyalty points over a period of twelve (12) months shall receive a sea-blue Lacoste-brand toiletries bag, with it hereby specified that you may only claim one Lacoste toiletries bag per twelve (12)-month period, and that in the event of a progression to a new status that entitles you to a gift specific to this new status, you may not clam the gift issued under LEVEL 2.
o Birthday offer: in addition to the benefits granted for LEVEL 2, we will offer you a Lacoste keyring, with it hereby specified that the choice of gift is left to our entire discretion and that all the limitations and conditions described above shall also be applicable to this paragraph.
o Exclusive Lacoste events (local sporting events, local events, presentation of collections at Lacoste Boutiques, etc.): you may benefit from special operations implemented by your reference Lacoste Boutique. You will be informed of these commercial operations by any method we deem suitable and appropriate (including, but not limited to: displays in the Customer Area, letter, email, SMS, etc.).
- LEVEL 4
In addition to the benefits to which you are entitled under LEVEL 3, LEVEL 4 entitles you to the following benefits:
o A free unique Lacoste Polo (hereafter the "Customised Lacoste Polo"): Members that have earned at least one thousand five hundred (1500) Loyalty points over a period of twelve (12) months shall receive a Customised Lacoste Polo with a unit value of one hundred and twenty (120) pounds including tax, with it hereby specified that you may only claim one Customised Lacoste Polo per twelve (12)- month period, and that in the event of a progression to a new status that entitles you to a gift specific to this new status, you may not clam the gift issued under LEVEL 3.
o Brand events (sporting events, meetings with players, private parties, etc.): you may benefit from special operations implemented for unique and high-impact events for the Lacoste brand. You will be informed of these commercial operations by any method we deem suitable and appropriate (including, but not limited to: displays in the Customer Area, letter, email, SMS, etc.).
o Birthday offer: in addition to the advantages granted at LEVEL 3, we offer you a Lacoste duffle bag, with it specified that all the limitations and conditions described above are also applicable to this paragraph.
As soon as the conditions that entitle the member to a Lacoste gift are fulfilled, you will be informed of this directly by your sales advisor at the Lacoste Boutique when you pay at the till, or at the time of validation of the points on the Site, or by email; the gifts shall be sent to you under the following conditions.
A Lacoste gift shall only be provided to you in the event the following conditions are fulfilled:
- you must have earned the sufficient number of Loyalty points to enable you to access a new status over a period of twelve (12) months;
- you must not have received the Lacoste gift relating to the same status within the last twelve (12) months.
If the event you access Level 4, you must immediately visit a Lacoste Boutique or log on to the Site to design your Customised Lacoste Polo. It will then be available three (3) weeks after your order at the earliest.
To collect your Lacoste gift, you must directly visit a Lacoste Boutique or your customer area.
In any event, you may order and collect your Lacoste gift at any time throughout the year following the acquisition of your new Status. After this, your right to obtain a Lacoste gift will expire and you may not then claim any right to this and may not claim any compensation.
Regardless of the gift obtained in accordance with the terms and conditions provided for above in articles 11, 12 and 13 of the General Conditions, it may only be returned within fifteen (15) days of receipt, in its original condition and packaging, at the Lacoste Boutique where it was collected and solely in the following cases:
- non-compliance with regard to the information provided by you at the time of the order;
- delivery of a defective product.
In these cases, and in the six (6) weeks following your return of the defective or non-compliant gift, we will replace it with another Lacoste gift of the same value and the same type, directly at your Lacoste Boutique or by contacting the customer service department through the contact form available at the following address: www.lacoste.com/ch/en/contactus
For any case other than those mentioned above, we hereby specify that the gift cannot be replaced under any circumstances.
In addition, and in all cases, the Lacoste gifts are never eligible for refund.
In the event that a Lacoste gift is out of stock, we undertake to replace it as soon as possible with a product of the same nature and/or the same value, based on the status reached.
We deny any liability regarding any harm, death, delay, injury or losses stemming from or in direct relation with the services, bonuses or benefits provided or not provided in the context of LE CLUB LACOSTE, to the exclusion of the losses and damages stemming from negligence committed by Lacoste Switzerland or Lacoste e-commerce, or provoked by this party with the intention to cause the aforementioned damage, or stemming from careless actions committed knowing that this would probably result in damage.
LE CLUB LACOSTE is a programme aimed at providing benefits for Members based on the purchases they make at the Lacoste Boutique or on the Site and assumes that the Member respects the General Conditions and adopts loyal behaviour with regard to Lacoste Switzerland and Lacoste e-commerce, respectful of the Lacoste Brands.
(i) any breach of the General Conditions;
(ii) any fraudulent use of the LE CLUB LACOSTE Loyalty programme by the Member or by any third party acting on behalf of the Member;
(iii) any action that intends to disrupt the Loyalty programme, the Application or any Lacoste Boutique;
(iv) any abnormally high number of transactions carried out in the same day or over several days;
(v) in the event of a payment incident that is not resolved within thirty (30) days of the purchase date; shall result in the lawful cancellation of all Loyalty points, as well as the deactivation and the deletion of the loyalty account without compensation of any kind.
We reserve the right to carry out verifications of adherence to the General Conditions at any time.
In the event you do not make any purchases over a consecutive period of thirty-six (36) months, the Loyalty account may be deactivated. We will inform you, by email (provided we have your email address), that if you do not make a purchase within thirty (30) days of receipt of the aforementioned email, your Loyalty account will be definitively deactivated, without compensation of any kind.
We reserve the right to modify or eliminate LE CLUB LACOSTE (conditions of membership, benefits linked to the Loyalty account, etc.) and/or the conditions of use of the Loyalty account, at any time. In the event of termination of LE CLUB LACOSTE, we will allow you the possibility to use the points accumulated for a period of one (1) month of informing you of this, by any method we deem appropriate. If you fail to use these points, the loyalty benefits shall be definitively lost.
In the event of a complaint, you may send a request to the Lacoste Switzerland and/or the Lacoste E- Commerce companies via the contact form on the www.lacoste.com/ch/en/contactus site, so they may investigate the issue.
Should either party fail to take action pursuant to the General Conditions, this does not constitute a waiver of the right to take action, unless this is expressly set out in writing.
These General Conditions are solely available in English.
These General Conditions apply from 27 March 2018, and shall automatically replace any former General Conditions previously in force, without you having the right to take action in this respect.
Membership of LE CLUB LACOSTE implies full acceptance of the General Conditions, without reservations. The General Conditions may be consulted or obtained upon simple request at the Lacoste Boutiques, on the Site, or via the contact form on the site www.lacoste.com/ch/en/contactus
The General Conditions are governed by English legislation. If any of the stipulations of these General Conditions is deemed invalid, void, or inapplicable for any reason, this stipulation shall be considered as divisible from the rest of the General Conditions and shall not affect the validity and applicability of the other stipulations of the General Conditions.
LACOSTE and the CROCODILE are registered trademarks belonging to the Lacoste S.A. company.
